General Information About the Personal Data Protection Law

The Law on the Protection of Personal Data Numbered 6698 (hereinafter referred to as PDPA) was adopted on March 24, 2016, and published in the Official Gazette dated April 7, 2016, with the number 29677. Some parts of the PDPA were published on the date of publication, while some became effective on October 7, 2016.

Information as the Data Controller

As per the PDPA numbered 6698 and as the Data Controller, your personal data will be recorded, stored, updated, and may be disclosed/transferred to third parties in the framework explained on this page and classified and may be processed in the ways specified in the PDPA.

Processing of Personal Data

According to the PDPA numbered 6698, your personal data shared with our company can be processed by us, either completely or partially, automatically, or, provided that it is a part of any data recording system, non-automatically, being recorded, stored, altered, reorganized, in short, processed by us in every way specified in the law. Any process performed on the data within the scope of the PDPA is accepted as the "processing of personal data."

Purposes and Legal Grounds for Processing Personal Data

The personal data you share will be processed by our company in line with the purposes of carrying out the requirements of the services provided to our customers, fulfilling the requirements of the contract, and technology; for being able to provide the products and services we offer, in accordance with the Law on the Regulation of Electronic Commerce Numbered 6563, the Consumer Protection Law Numbered 6502, and the Regulation on Service Providers and Intermediary Service Providers in Electronic Commerce published in the Official Gazette dated August 26, 2015, with the number 29457 and prepared based on these regulations, the Distance Contracts Regulation published in the Official Gazette dated November 27, 2014, with the number 29188, and other relevant legislation.

For the purposes of determining the information of the transaction owner in the scope of the transactions carried out in the fields of banking and electronic payment, required by law, and for regulating all records and documents that will form the basis for the processing of transactions in electronic or paper form; for complying with the legal obligations regarding the preservation, reporting, and informing obligations stipulated by the legislation; in legal disputes and demands, and to be able to provide information to the prosecutor's offices, courts, and relevant public officials upon request and by law.

Transfer of Personal Data Abroad

Your personal data collected by any of the methods mentioned above may be transferred to service providers abroad who are in compliance with the PDPA and in line with the purposes of the contract.

Storage and Protection of Personal Data

Your personal data will be kept confidentially in the database and systems of our company, in accordance with Article 12 of the PDPA; it will not be shared with third parties in any way other than legal obligations and the regulations specified in this document. Our company is obliged to take software measures such as preventing the unlawful processing of personal data, preventing unauthorized access, and access management, as well as taking physical security measures.

Keeping Personal Data Up-to-Date and Accurate

Our company is obliged to keep your personal data accurate and up-to-date under Article 4 of the PDPA. In this context, our customers must share or update their accurate and up-to-date data via the website/mobile application to fulfill our company's legal obligations.

Rights of the Personal Data Subject under the PDPA

As of October 7, 2016, with the effective date of Article 11 of the PDPA, the rights of the Personal Data Subject are as follows:

  • The right to learn whether personal data is processed;
  • If personal data has been processed, the right to request information about it;
  • The right to learn the purpose of processing personal data and whether they are used appropriately for their purpose;
  • The right to know the third parties to whom personal data is transferred domestically or abroad;
  • The right to request the correction of personal data in case of incomplete or incorrect processing;
  • The right to request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the PDPA;
  • The right to request the notification of the transactions made pursuant to subparagraphs (e) and (f) to third parties to whom personal data has been transferred;
  • The right to object to the occurrence of a result against the individual by analyzing the processed data exclusively through automated systems;
  • The right to request the compensation of the damage in case of damage due to the unlawful processing of personal data.
